Apple adds Jelly Bean, Samsung GALAXY Note 10.1 and Samsung GALAXY Nexus in latest patent suitBefore the Apple iPhone 5 launched on September 21st, Samsung warned Apple that because of 8 LTE patents it owns, if the device launched on schedule, it would add the device to a patent suit it faces in San Jose against Apple. On October 1st, the Korean manufacturer did just that, leading to Apple's actions on Tuesday. Today, Apple spoke with U.S. Magistrate Judge Paul S. Grewal and stated that the Samsung GALAXY Note 10.1 tablet infringes on Apple patents and wants to add Android 4.1 to the lawsuit.

Apple wants to add 17 Samsung devices to its list of products made by the Korean manufacturer that allegedly infringe on Apple patents. According to Apple attorney Andrew Liao, these 17 devices should be added to Apple's claims because they can support a stylus even though none of them shipped with one. Amongst the 17 is the Samsung GALAXY Nexus, which Apple says is the only Android device with Jelly Bean that it will add to the suit. Samsung attorney Victoria Maroulis says the Korean firm is against adding the stylus enabled devices to the suit, stating that it will "enlarge the case significantly." She also pointed out that while Apple wants to add 17 devices, Samsung wants to add just one, the Apple iPhone 5. Judge Lucy Koh previously placed a preliminary injunction against the Samsung GALAXY Nexus, a decision that was overturned by an appeals court that said that Judge Koh absued her discretion.

Judge Grewal didn't issue a ruling today, fearing that if both sides requests were denied, it would lead to a number of new lawsuits. Grewal did say that the trial that these requests are being made for, won't startuntil 2014. But plenty of action will be going on next month in the same courthouse in San Jose. On December 6th, Judge Lucy Koh, who presided over the earlier patent lawsuit between Samsung and Apple,will hear some post trial motions including Apple's request to add to the amount of the verdict, Samsung's request for a new trial based on juror misconduct, and Apple's request for permanent bans in the U.S. for 8 Samsung smartphones and the Samsung GALAXY Tab 10.1. Judge Koh removed a preliminary injunction against the tablet after the jury did not find that it had infringed on Apple's design patents.
